Red-Radio Standard Terms & Conditions of Sale

1. Definitions

1.1. Red-Radio, is hereafter referred to as the Seller. The purchaser, is hereafter referred to as the Buyer.

2. Prices

Prices are correct at time of printing, (or shown on website) but may be amended by the Seller by giving the Buyer written confirmation at time of enquiry.

Any Quotation for equipment will remain valid for a period of 30 days and prices held at the prices quoted.

All prices quoted herein are exclusive of carriage and VAT, where applicable.

2. Acceptance

2.1. All prices and quotations are given and orders accepted to the following express Terms & Conditions of Sale and no additions or alterations(including in particular any terms and conditions stated by the Buyers contract and order form) shall apply unless specifically agreed in writing by the Seller. In the absence of written acceptance of these terms, the giving of any instruction for work or order or acceptance of or payments for any goods or service by the Buyer shall constitute an acceptance of these terms.

All order terms and contracts can be reviewed until there is acceptance in writing between the Seller and the Buyer or an Invoice is issued by the Seller.

3. Delivery, Risk and Title

3.1 Unless otherwise agreed, all shipments are dispatched from the Sellers facility and packed in accordance with the Sellers standard practice.

3.2 The risk in the goods shall pass to the Buyer at the point of delivery.

3.3 Notwithstanding delivery and the passing risk of:

3.3.1. The Goods shall remain the property of the Seller until the Buyer has paid all monies owed by the Buyer to the Seller for (i) the particular order/shipment.,(ii) Under this contract and (iii) Under any other contract between the Buyer and the Seller.

3.3.2. If the Buyer shall enter into liquidation or receivership with its creditors or upon any breach by the Buyer of any of its obligations whether as to payment or otherwise the Seller may (without prejudice to any of its other rights and remedies) by notice served in writing the Seller or its agent may recover and resell any or all of such goods and materials and may enter upon the Buyers premises for that purpose.

3.3.3. The Seller guarantees to give a full refund if goods are returned within 7 days of Invoice, less any carriage charges. Goods must be unused and boxed as supplied by the Seller. Nothing herein, unless faulty, shall give the Buyer the right to return goods to the Seller unless the Seller authorises such return in writing. The Seller reserves the right to charge a re-stocking fee of 10% of the original order value.

4. Terms and payment

4.1 All prices are in Pounds Sterling (£ GPB), and shall be paid in full to the Seller. Terms of payment are stated on the Invoice relating to the goods &services supplied.

4.2 Unless otherwise agreed our standard terms of payment are Cash with Order, by pro-forma invoice or Invoice on delivery for immediate payment or, If agreed in advance, credit terms of 30 days from invoice date. The Seller reserves the right at any time to revoke any credit extended to the Buyer because of the Buyer’s failure to pay for any goods and services when due or any other reason deemed good and sufficient by the Seller. In any such event all subsequent shipments shall be paid for before delivery.

4.3 The Seller reserves the right to charge interest to the Buyer’s account on invoices that are outstanding at the end of one month from the date stated on the invoice when payment was due.

5. Governing Law

5.1 This contract and all disputes relating to it shall be governed and constructed in all respects according to English law. E&OE.

6. Disputes

6.1 If at any time a dispute or difference arises in connection with the order, it shall be mutually agreed upon between the Buyer and the Seller or, in the event that agreement cannot be reached, then the dispute shall be settled by an independent arbitrator, to be appointed by the President of Law Society, whose decision shall be binding upon both parties.

WARRANTY

In principle, Red-Radio will replace free of charge any product found unserviceable upon opening the product packaging for up to 90 days from date of invoice, subject to Manufacturers Conditions of Return.

To return a product, please call our office on 01582 481114 and request a Returns number (Returns Authorisation). This should be used on any returns paperwork.

Any costs associated with the return of the product to the Seller will be borne by the purchaser; Red-Radio will pay for carriage of its return replacement.

With the exception of some accessories our products have serial numbers and to avoid any ambiguity we ask the purchaser to use these numbers on any returns.

The following conditions apply:–

All serial number labels must be intact. The product must not be damaged, marked or changed in any way.

The returned product must be in its original packaging.

The product must be returned with paperwork stating the Returns number.

A product of the same description (subject to availability) will be despatched and invoiced (free of charge) within 24 hours (using best endeavours).

Product returned which does not meet the above criteria will be returned at the customer’s expense.. A credit will not be issued for the replacement equipment, and will be invoiced at the normal rate.

From the date of our invoice, we offer to the Purchaser a 24 month warranty on all new RED, Lynx series radios supplied by Red-Radio, and standard Manufacturers warranty on all other equipment supplied.

Returns Procedure

This procedure must be used when returning any goods to Red-Radio. Simply phone our office and have the following information to hand.

Your name and Company.

Description of product being returned including:

– Product name

– Serial number

– Date of purchase

– Description of fault

– Description of accessories accompanying product

– Reason for return

On receipt of this information you will be issued a Returns number.
